Fly Tip Witness Report
Please note: fly tipping is a criminal offence under S.33 of the Environmental Protection Act 1990. Any enforcement action taken by the Council in relation to fly tipping must therefore satisfy a criminal burden of proof i.e. beyond reasonable doubt.
We are interested in hearing from you in the following circumstances:
1) You have witnessed a fly tip, you know the identity of the person / people responsible AND what you saw can be corroborated by a third party, OR
2) You have witnessed a fly tip, do not know the identity of the person / people responsible BUT have photographic / video evidence of the incident including a complete vehicle registration number, OR
3) You did not witness a fly tip, but have discovered a fly tip containing items of evidential value e.g. a delivery label with a name and address on it.
It is important to understand that in some circumstances we may need to take a formal witness statement from you, and that you may be required to provide evidence in Court.
